1. General Terms and Conditions

Overview Welcome to Premier Wholesale Supply of Arizona, LLC (“PWS-AZ”). These terms and conditions outline the rules and regulations for the use of our services and the purchase of our products.

Scope of Agreement These terms and conditions apply to all transactions between PWS-AZ and its customers. By placing an order or using our services, you agree to be bound by these terms.

Acceptance of Terms Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users, and others who access or use the service.

2. Return Policy

Eligibility for Returns Products may be returned within 30 days of purchase if they are in their original condition and packaging. Proof of purchase is required.

Return Process To initiate a return, contact our customer service department at bianca@premierwholesaleaz.com or 602-368-2004.

Condition of Returned Goods Returned items must be unused, in original packaging, and in resalable condition. Items that are damaged, used, or not in their original packaging will not be accepted.

Non-Returnable Items Custom orders, special orders, and items marked as “final sale” are not eligible for return.

3. Restocking Fee

Restocking Fee Percentage A restocking fee of 20% of the purchase price will be deducted from the refund for returned items that are subject to this fee.

Conditions for Restocking Fee Waiver The restocking fee may be waived if the return is due to an error on our part, such as incorrect shipment or defective product.

4. Bid Validity

Bid Duration All bids are valid for a period of 30 days from the date of issue unless otherwise specified.

Acceptance of Bids Bids must be accepted in writing within the validity period. Acceptance after the validity period may require a new bid.

Modifications and Cancellations Bids may be modified or canceled within the validity period upon mutual agreement. Any changes may affect the pricing and terms.

5. Pricing and Payment Terms

Price Quotations Prices quoted are based on current market conditions and are subject to change without notice.

Invoice Review The Customer agrees to review all invoices promptly upon receipt. If the Customer believes that there are any discrepancies, errors, or disputes regarding the charges, fees, or amounts detailed in an invoice, the Customer must notify PWS-AZ in writing within 7 days of receipt of the invoice. Failure to notify PWS-AZ within this time frame will result in the invoice being deemed accurate and accepted by the Customer, and all charges will be considered valid and payable in full. Any disputes raised after the specified time frame will not be entertained, and the Customer waives the right to contest such charges.

Payment Methods We accept payment via cash, credit card, bank transfer, and approved credit accounts.

Late Payment Penalties Invoices not paid within the agreed terms will incur a late payment fee of 1.5% per month. In the event that it is necessary for PWS-AZ to use legal action and/or the services of a collection agency to collect our account, the customer agrees to pay all reasonable costs incurred including attorney fees and court costs. We further agree that if any legal action were brought in connection with this agreement, that such action be brought in Maricopa County, Arizona.

6. Shipping and Delivery

Delivery Times Estimated delivery times are provided at the time of order and are subject to change based on availability.

7. Warranty and Liability

Product Warranties PWS-AZ warrants that all products sold are free from defects in material and workmanship under normal use and service for a period specified by the manufacturer (if applicable).

Warranty Period The specific warranty period for each product is detailed in the manufacturer’s warranty documentation provided with the product.

Coverage This warranty covers defects in materials and workmanship. It does not cover damages caused by misuse, abuse, accidents, unauthorized alterations or repairs, improper installation, or failure to follow the product’s usage instructions.

Warranty Claims Process To initiate a warranty claim, customers must contact PWS-AZ at bianca@premierwholesaleaz.com or 602-368-2004 with proof of purchase, installation date, and a detailed description of the defect.

Inspection and Repair or Replacement Upon receipt of the defective product, PWS-AZ will inspect the item to determine the cause of the defect. If the product is found to be defective within the terms of the warranty, we will, at our discretion, replace the product at no additional cost to the customer.

Limitations of Liability Liability under this warranty is limited to the replacement of the defective product. We are not responsible for any incidental, indirect, or consequential damages, including but not limited to loss of use, loss of profits, or any other financial loss arising from the use of or inability to use the product.

8. Privacy and Confidentiality

Data Protection We are committed to protecting your privacy. Personal information collected during transactions is used solely for processing orders and providing customer service.

Use of Customer Information Customer information will not be shared with third parties without consent, except as required by law.

Confidentiality Obligations Both parties agree to keep confidential any proprietary information received during the course of business transactions.

9. Dispute Resolution

Governing Law These terms and conditions are governed by the laws of the State of Arizona.

Arbitration and Mediation Any disputes arising from these terms will be resolved through binding arbitration or mediation.

Jurisdiction The courts of Arizona will have exclusive jurisdiction over any disputes not resolved through arbitration or mediation.

10. Amendments and Modifications

Changes to Terms We reserve the right to amend these terms and conditions at any time. Changes will be effective upon posting on our website.

Customer Agreement to Amendments Continued use of our services constitutes acceptance of any amendments to these terms and conditions.
